Placer Discover: New York 2024

Substitutions
‍Substitution requests can be processed only via email request to events@placer.ai. An email from the original registrant, including the name of the substitute registrant is required to authorize the transfer. All requests for substitutions must be received no later than 5:00 PM EST on December 1, 2024 to have a substitution processed. Substitutions may incur a $25 processing fee.

‍Cancellations
‍The Placer.ai Registration Team must receive all cancellation requests in writing or via e-mail to  events@placer.ai by 5:00 PM EST on December 1, 2024. See below regarding eligibility for refund.

‍Refunds
‍We will issue a full refund, less a 10% cancellation fee, for written cancellation requests received on or before October 15, 2024 at 11:59 PM EST. Cancellation requests received between October 16, 2024 and November 10, 2024 at 11:59 PM EST, will be issued a 50% refund, less a 10% cancellation fee. No refunds will be offered for paid items after November 10, 2024. Refunds will be processed 5 to 7 business days after the cancellation request has been processed and confirmed to the method of payment on the attendee record. If you have not received a refund by December 15, 2024, please contact the events team at events@placer.ai.  
 
‍Payment Information
‍Payment will be accepted in U.S. dollars only via credit card payment. We are unable to accept payment via wire or check. Payment must be received in full to print attendee badge on-site.

‍Terms and Conditions
‍By registering for the Placer Discover:New York 2024 event, you agree to comply with the event Terms and Conditions.
‍
The following event terms and conditions (the “Event Terms”) govern your registration and attendance at Placer Discover: New York 2024 (the “Event”) and are an agreement between you and Placer Labs, Inc. and its affiliates and subsidiaries (hereinafter “Placer.ai”). You represent to us that you are authorized to enter into these Event Terms, which may be updated from time to time. Registering to attend or participating in the Event constitutes your acceptance of these Event Terms.

‍Promotion Codes
‍If you have purchased or received a promotion code, such codes may not be shared or provided to anyone outside your company. Only one (1) code can be applied per registration. Placer.ai reserves the right, including without prior notice, to cancel or impose conditions on the honoring of any promotion.

‍Payment
‍Event fees may apply to your attendance or participation in an in-person or virtual Event. Payment (if applicable) must be provided in the manner and at the times noted on the Event registration page. Registration is not confirmed until payment has been received and Placer.ai reserves the right to cancel your registration without notice for failure to pay as required. Unless specified otherwise, registration is valid exclusively for the specified Event and not for any other event sponsored by Placer.ai. You are responsible for any taxes applicable to your payment transactions.

‍Refunds, Substitutions and Cancellations
‍Placer.ai may permit a refund or substitution of your registration for the Event to another person within your company at Placer.ai's discretion, subject to the Event’s applicable refund, substitution and cancellation policies set forth on the Event registration page. There are no refunds or credits for no‑shows. Payments made for the Event may not be applied toward the purchase of any other event. Cancellation of travel reservations and hotel reservations is your exclusive responsibility. Placer.ai is not responsible for any damages, direct or indirect, resulting from any canceled registration or impermissible substitution.

‍Minimum Age
‍For all Event activities, you must be at least 21 years of age to attend.

‍Badges
‍You may be required to present identification and pick up a badge at the Event check‑in area before entering the Event. If badges are required for admittance, they must be worn and visible at all times while you are at the Event and during any activity associated with the Event. Badges may not be shared or exchanged with any person.

‍Personal Information
‍Placer.ai will handle your personal information collected during registration in accordance with Placer.ai's Privacy Policy. Please note that this personal information will also be shared with event sponsors and partners.

‍Registration Information 
‍You agree that Placer.ai may use your registration information to send you updates and requests for feedback regarding the Event or for other business purposes. You also agree that Placer.ai may use and disclose your personal information to its third‑party service providers to process your registration. Such third parties may have their own privacy policies that apply to their processing of your personal information.

‍Disclosing Your Registration Information 
‍Badges may contain technology that may be used to record your attendance and participation in the Event (including visiting booths and attending sessions). You authorize Placer.ai to disclose your registration information to Event Sponsors to use in accordance with their privacy policy if (a) you scan your badge, elect to visit a sponsor’s booth, or attend any in-person or virtual sessions or other activities at the Event involving Event Sponsors (in which case we would provide your registration information only to the Event Sponsor involved in such session or other activity,) or (b) you opt-in during registration or otherwise to receive communications from our Event Sponsors. Placer.ai is not responsible for the privacy practices of any Event Sponsor or other third party. Please contact the Event Sponsor or third party to learn more about its practices with respect to any information that it collects or to unsubscribe from its marketing communications.

‍Recordings
‍You may not record any sessions at the Event without prior approval from Placer.ai. You acknowledge and agree that the Event is a public event, that your appearance and actions inside and outside the venue where the Event occurs are public in nature. Placer.ai, including its affiliates, partners, vendors and other third parties, may choose to photograph and record certain portions of the conference, including in public areas, which may capture images, video and/or recordings of conference participants. By virtue of your attendance at the Event, you acknowledge and consent that your likeness and/or voice may be captured in these materials and grant Placer.ai and such third parties the right to use, modify, reproduce, broadcast, distribute, display, or incorporate in any manner whatsoever, all or any portion of these materials, free of charge, for marketing, training and internal purposes. You hereby waive “moral rights” in such photos, recordings, or other digital content.

‍Government Attendees
‍If you are a government employee or official, you must identify yourself as such during the registration process for the Event, and you may be asked to present your government-issued employee badge during the check-in process. If you are offered free or discounted attendance or participation at the Event, you must disclose your attendance at the Event to your employing government agency in advance, and obtain such agency’s permission for you to accept free or discounted attendance at theEvent. You must also confirm your compliance with the foregoing upon request by Placer.ai and comply, for the entire duration of the Event, with all applicable rules, regulations and policies imposed by your employing agency, including those relating to the acceptance and disclosure of gifts and gratuities.

‍Event Conduct
‍You are required to comply with the Placer.ai Code of Conduct and the rules of the venue. Placer.ai reserves the right to refuse admission to, or to eject, any person who has registered under false pretenses (e.g., companies or attendee names that do not exist, individuals who are under-aged, etc.) or who fails to follow any of Placer.ai’ other rules or directions, as determined by Placer.ai in its sole discretion.

‍Changes to Event
‍Placer.ai reserves the right to make any changes to the Event, its content and/or programs offered at any time and without notice, including the availability or suitability of venue or speakers or on security, health, or safety grounds, and in the event of any natural or public disaster, insufficient participation or sponsorship, government regulation or shutdown, necessary venue construction, labor controversy, civil disturbance, acts or threats of terrorism, armed conflict or similar reasons beyond its reasonable control. Placer.ai is not responsible for, and no reimbursement will be issued in the event of, any change to an Event.

‍Safety and Security
‍Your safety and security are important to us. You understand that you and your property may be subject to a reasonable search upon entry to the Event and you may be asked to provide photo identification. Your bags may be required to be stored during the event. If you refuse to participate in these security measures, we may deny you entry. We also reserve the right to ask you to leave the Event if your behavior causes us concern for the safety or security of Event attendees.

‍Assumption of Risk; Health and Safety
‍YOU UNDERSTAND THAT PARTICIPATION IN THE EVENT IS VOLUNTARY AND YOU ACKNOWLEDGE AND AGREE THAT: (I) ATTENDING IN-PERSON EVENTS CARRIES WITH IT CERTAIN INHERENT RISKS THAT CANNOT BE ELIMINATED REGARDLESS OF THE CARE TAKEN TO AVOID INJURIES; AND (II) IN-PERSON EVENT PARTICIPATION INCLUDES POSSIBLE EXPOSURE TO AND ILLNESS FROM INFECTIOUS DISEASES. YOU UNDERSTAND AND ASSUME ALL RELATED HEALTH AND SAFETY RISKS ASSOCIATED WITH ATTENDING THE EVENT, INCLUDING RISKS RELATED TO COVID-19. Attendees will be required to meet any government-mandated health and safety requirements (including vaccination requirements), or any health and safety requirements imposed by the host or venue, to attend. If we deny you entry or require you to leave, you will not receive a refund.

‍Release of Claims
‍TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY EXPRESSLY AGREE TO RELEASE PLACER.AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, VENDORS, PARTNERS, AGENTS AND CONTRACTORS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASEES”) FROM ANY AND ALL ALLEGED AND/OR ACTUAL LIABILITY, CLAIMS, ACTIONS, LAWSUITS, DAMAGES AND LOSSES OF ANY KIND WHICH ARISE OUT OF OR RESULT FROM YOUR ATTENDANCE AT AND PARTICIPATION IN THE EVENT AND ANCILLARY ACTIVITIES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, FINANCIAL LOSS, PERSONAL OR PSYCHOLOGICAL INJURIES, ILLNESS, PAIN, TEMPORARY OR PERMANENT SUFFERING, DISABILITY, DEATH OR OTHER PHYSICAL LOSS, WHETHER OR NOT FORESEEABLE, AND WHETHER ARISING OUT OF THE ORDINARY NEGLIGENCE OF PLACER.AI OR ANY RELEASEES OR OTHERWISE. YOU COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIMS AGAINST PLACER.AI OR ANY OTHER RELEASEE, AND FOREVER RELEASE AND DISCHARGE PLACER.AI AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS. THIS WAIVER AND RELEASE DOES NOT EXTEND TO CLAIMS FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITIES THAT CALIFORNIA LAW OR OTHER APPLICABLE LAW DOES NOT PERMIT TO BE RELEASED BY AGREEMENT.

‍Limitation of Liability
‍PLACER.AI AND OUR AFFILIATES AND LICENSORS WILL NOT BE LIABLE TO YOU UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR (B) LOST PROFITS, REVENUES, CUSTOMERS, OPPORTUNITIES, OR GOODWILL. IN ANY CASE, Placer.ai AND OUR AFFILIATES’ AND LICENSORS’ AGGREGATE LIABILITY UNDER THESE EVENT TERMS WILL NOT EXCEED THE EVENT REGISTRATION FEES, IF ANY, PAID BY YOU TO AND RECEIVED BY PLACER.AI FOR THE EVENT GIVING RISE TO THE LIABILITY. THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

‍Governing Law
‍Any dispute or claim (including non-contractual disputes or claims) arising under or in connection with the Event Terms, their subject matter, or formation (“Dispute”) shall be governed by and will be construed in accordance with the laws of the State of California without regard to the choice of law provision therein.

‍Complete Agreement/Severability
‍If any provision of these Event Terms is for any reason found to be unenforceable, the remainder of these Event Terms will continue in full force and effect to the fullest extent permitted by law. These Event Terms and their incorporated documents constitute the complete and exclusive understanding and agreement of the parties and supersede all prior understandings and agreements, whether written or oral, with respect to the subject matter hereof.CODE OF CONDUCT

‍EVENT STANDARDS OF CONDUCT
‍Placer.ai is committed to creating a safe and inclusive experience for all Event Sponsors and attendees, regardless of gender, sexual orientation, disability, physical appearance, body size, race, or religion. Harassment in any form is prohibited. All communication should be appropriate for a professional audience, including people of different backgrounds and experiences. Attendees are expected to be kind to others, avoid insulting or putting down other attendees, and act professionally. Harassment and sexist, racist, or exclusionary behavior or comments (including jokes) are not appropriate at any time at the Event or any event organized by Placer.ai. Unwanted physical touching, violence, or threats are strictly prohibited. These Event Standards of Conduct apply to all Event Sponsors and attendees.

‍INTERACTION GUIDELINES FOR ATTENDEES
‍For all interactions during the Placer.ai Discover: New York 2024, we expect participants to abide by the Event’s Code of Conduct to ensure the environment remains productive and respectful. The following guidelines will further help ensure we maintain an inclusive experience throughout the Event:Be respectful of others.Avoid conflicts and arguments.Use common sense, kindness, and consideration together with the guidelines outlined above.If you intend to participate in the Event, please make sure to dress appropriately.If you drink alcohol at the Event, do so responsibly

‍ENFORCEMENT
‍If any Sponsor or attendee engages in behavior that fails to comply with the Event Standards of Conduct, Placer.ai may, in its sole discretion, take any action that it deems appropriate to address the behavior, including warning the participant, excluding the participant from any Event-related activities, prohibiting the participant from attending future events organized by Placer.ai, expelling the participant from the Event, banning the participant from online chats and/or other similar type experiences. Participants asked to stop any inappropriate behavior are expected to comply immediately. Placer.ai may ask anyone violating these rules to leave the Event without a refund. In the case of illegal activity, Placer.ai may also pursue other legally available remedies.

‍REPORTING AN ISSUE
‍Placer.ai asks Sponsors and attendees to remain vigilant for misconduct that violates these Event Standards of Conduct and to speak up if they are the target of or notice such behavior by other participants. Event attendees may share complaints of misbehavior with Placer.ai via email at events@placer.ai. Placer.ai has a strict non-retaliation policy for anyone who makes a good-faith report of misconduct or provides information in support of any investigation of misconduct. To enable a prompt and thorough investigation of complaints, Placer.ai asks that reporters provide their name, phone number, email, and a description of the situation with as much detail as possible. While Placer.ai takes all concerns raised seriously, it will use its discretion to determine when and how to follow up on reported incidents. Placer.ai may decline to take further action and/or direct the participant to other resources to address the concern. The reporting mechanisms under the Event Standards of Conduct are not intended to address criminal activity or emergencies. Participants who believe they have been the victim of a crime or experience or observe an emergency requiring immediate response (such as a threat of harm to any individual’s health or safety) should immediately contact the appropriate municipal authorities, such as the police, fire, medical, or other emergency responder.

‍REPORTING OTHER ISSUES
‍Any other issues that arise during the Event and may require real-time assistance (e.g., accessibility or facilities issues) may be addressed to the relevant Placer.ai Marketing contact on-site.

‍Presenters who are unsure whether their presentations or other materials and communications are consistent with these expectations, please contact the Events team in advance of the experience at events@placer.ai.
